FCPOA Board Members Election Notice *** May 22, 2014 – 5pm – 8pm***

At a Special Meeting on April 30, 2014, the Board and POA Members appointed a Committee on Nominations and Elections. The Committee Members are Larry Middleton, Brynn Siniaho and Wendy Aldridge, with Larry Middleton as Chair. The role of the Election Committee is to hire an impartial team responsible for registering votes and counting ballots, enforcing all rules and regulations pertaining to Bylaws and Texas Property Code and to announce number of seats and know candidates running.

At the meeting the Committee encouraged all eligible property owners who have an interest in becoming a Member of the Board of Directors to submit their name and qualifications for inclusion on the ballot. Members who have attended public Board meetings were called and asked if they would serve on the Board. Several Members announced their candidacy. Additionally all rules and regulations pertaining to Forest Cove POA Board Member elections were discussed.

The annual meeting of the Forest Cove Property Owners Association will be held on May 22, 2014, at 7:30 p. m. at the Forest Cove Community Center, 1025 Marina Drive. The purpose of this meeting is to receive reports of all officers and committees, elect Directors, and transact all other business such as may come before the meeting. Three members of the Board of Directors will be elected to fill the vacancies of three Directors whose terms expire on May 22, 2014.

The election of Board Members will be held at the annual meeting of the Forest Cove Property Owners Association on May 22, 2010, from 5:00pm until 8:00pm at the Forest Cove Community Center, 1025 Marina Drive.

***Voting will begin at 5:00pm and end at 8:00pm, Thursday, May 22, 2014 at the Community Center.***

The known candidates are:

• Vizi Caldwell
• Steve Atchison
• Wade Hopper
• Marian Burrows
• Walt Cook

In addition, write-ins are allowed on voting day.

In accordance with the Forest Cove POA Bylaws and the Texas Property Code the Rules and Regulations for the upcoming election of the new Forest Cove POA Board of Directors are:

1/ Any member of the Forest Cove POA, that is any person or entity that owns property in Forest Cove is eligible to run for office on the Board of Directors.

2/ Any member of the Forest Cove POA is eligible to vote, regardless of whether they are in arrears in their dues or whether they are currently in a dispute with the POA.

3/ All ballots must be signed by the voter. Any unsigned ballot will be deemed invalid.

4/ Any voter can write-in a candidate as long as that candidate is a bona-fide Forest Cove Member.

5/ ARTICLE III, SECTION 2 of the Forest Cove Bylaws states:
“Any persons or entity who own or hold a valid contract to purchase a lot in Forest Cove, sections 1 through 7 or in Forest Cove Country Club Estates, section 1 through 4A, or in any future section of Forest Cove which is approved for the purpose of this section of these bylaws by the Board of Directors of this corporation, or who occupy a home therein provided by an employer, shall be eligible for one membership.”

“Each member (…) shall be entitled to ONE VOTE on each matter submitted to a vote of the members.”

This means that any property owner is entitled to ONE VOTE only, regardless of however many properties they own in Forest Cove. It also means that if a property is owned jointly, by 2 or 3 or more persons, married or not, this group of people only gets ONE VOTE. That is, a group of persons jointly owning one or several houses in Forest Cove only gets ONE VOTE.

Any vote not cast in accordance with these rules will be therefore judged invalid.

Anyone needing to vote before Thursday, May 22 2014, can do so by going to Price & Price this Monday, May 19 through Wednesday, May 21, from 8:00am to 5:00pm. Upon presentation of your ID and establishment of proof of residence, you will be given a ballot to fill out and hand over to Price & Price. Your vote will be counted on May 22, 2014.
